- Our liability is limited to the maximum the law allows. We do NOT exclude liability for death or personal injury caused by our negligence, or your statutory consumer rights.
By using Pathix Go you agree to these Terms. If you do not agree, do not use the app.
1.Reference aid only
Pathix Go is a quick-reference aid. Its reference data and calculators are compiled from recognised engineering standards and handbooks and are for general information only. It is NOT a controlled document, NOT a substitute for the current controlling standard, specification, manufacturer's data or your organisation's approved data, and does NOT constitute professional, engineering, safety or design advice.
2.Your responsibilities
You will independently verify every value, result and output against the current controlling standard or manufacturer's data before relying on it. You are solely responsible for all calculations, designs, machining, inspection, manufacturing, safety and other decisions taken by you or anyone relying on your work, and for determining whether the app is fit for your purpose and compliant with applicable standards and your employer's procedures. You assume all risk arising from your use of the app. Reliance on the app without independent verification is unreasonable and at your own risk.
3.No warranty
To the fullest extent permitted by law, the app and its content are provided “as is” and “as available”, without warranty of any kind — including as to accuracy, completeness, currency, quality or fitness for a particular purpose. We do not warrant the content is accurate, complete, current or error-free.
4.Limitation of liability
To the fullest extent permitted by law, and subject to section 5, we are not liable for any loss or damage arising from your use of, or reliance on, the app — including any indirect or consequential loss, loss of profit, scrapped or reworked material, downtime, equipment damage or data loss. This limit applies however the liability arises, whether in contract, in tort (including negligence), for breach of statutory duty, or otherwise. Where liability cannot be excluded but can be limited, our total aggregate liability is limited to the greater of what you paid for the app in the prior 12 months or £100.
5.Liabilities we do not exclude
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded. If you are a consumer, your statutory rights under the Consumer Rights Act 2015 are not affected, and any term applies only so far as it is fair and permitted by law.
6.Licence & IP
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your own reference purposes. The app, its design and the compilation of its data are owned by or licensed to PATHIX LTD. Standards and trademarks referenced belong to their respective owners; Pathix is an independent tool, not affiliated with or endorsed by any standards body or manufacturer.
7.Updates & changes
The app may check for and download over-the-air updates automatically (see the Privacy Policy). We may update these Terms; a material change will ask you to accept again before continued use.
8.Governing law
These Terms are governed by the law of England and Wales, whose courts have jurisdiction, without depriving a consumer of mandatory local protections. Contact: legal@pathix.co.uk.
